BISMARCK, N.D. (AP) -- A jury has acquitted a Bismarck man accused of felony child neglect after a toddler in his care nearly drowned in an apartment complex swimming pool.
The acquittal Tuesday for Rolland Noheart came from a jury in Burleigh County. Prosecutors alleged Noheart did not immediately come to the rescue of the 18-month-old after the child fell in the water. Authorities also say that when Noheart finally pulled the boy from the water, he let the limp child fall over and strike his head on concrete.
Noheart's mother, Joyce Kitson, says her son did help save the child, despite some problems moving his arms.
